If you do not agree to these Terms, you must not use the Website or Services.
2. Eligibility
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Services.
By using the Website, you represent and warrant that you have the legal capacity to enter into a binding agreement with us and that you will comply with these Terms and all applicable laws.

Pictivio provides, among other things:
Access to and purchase of digital photographic content and related media (“Content”);
Various creative and photography-related services, which may include, without limitation:

Live & Loud
Meme Lab
Full-Service Shoots
A platform for certain users to submit and sell their own photographs or other content as contributors/sellers (subject to Contributor Terms in Section 10 below).
We may update, modify, suspend, or discontinue any part of the Website or Services at any time, with or without notice, and without liability, provided that such changes do not unreasonably prejudice users who have already entered into confirmed transactions.
4. Accounts and Registration
To access certain features (such as purchasing content, booking services, or acting as a contributor), you may be required to create an account.
You agree to:
Provide accurate, current, and complete information during registration;
Maintain and promptly update your information as needed;
Keep your login credentials confidential and not share your account with others;
Notify us promptly at hello@pictivio.com
if you suspect any unauthorised use of your account.
You are responsible for all activities that occur under your account, unless you have notified us in a timely manner of unauthorised access and we have had a reasonable opportunity to act.
We reserve the right to suspend or terminate accounts that violate these Terms or are used in a fraudulent or abusive manner.
5. Purchases, Pricing and Currency
Prices for digital content and services are displayed on the Website and are generally denominated in United States Dollars (USD), unless otherwise indicated.
We may change prices, fees, and available offers from time to time at our discretion.
Applicable taxes, if any, will be shown at checkout where required.
Available payment methods and any related conditions are displayed in the checkout process.
Payments may be processed by third-party payment service providers. You agree to comply with any additional terms presented by such providers when completing a transaction.
Refunds, cancellations, and related matters are governed by our Refund Policy, as published on the Website.
6. Digital Content and Downloads
When you purchase or obtain digital content (such as photographs) from Pictivio, you do not acquire ownership of the underlying intellectual property rights, but instead receive a license to use that content as specified in:
These Terms; and
Any specific licensing or usage terms presented on the product page, during checkout, or in a separate Photo Licensing or Content License document.
You agree that:
Digital content is provided in electronic form only;
Delivery is typically completed by providing access to downloads or account-based access;
Technical requirements (file formats, resolution, etc.) may vary by product and are generally indicated on the Website or product description.
You are responsible for ensuring that your devices, software, and internet connection are compatible with and capable of accessing the digital content.
7. License to Use Purchased Content
Unless otherwise stated in specific licensing terms, and subject to full payment of applicable fees, Pictivio grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use purchased content for permitted purposes, which may include personal, editorial, or commercial use, depending on the product and license type.
You must not:
Resell, redistribute, or sub-license the content as a standalone file or as a stock resource;
Claim copyright ownership of the content;
Use the content in any manner that is unlawful, defamatory, misleading, hateful, discriminatory, or otherwise harmful;
Use content in a way that implies endorsement by any person or entity depicted, unless explicitly permitted.
Some uses (for example, high-volume commercial reproduction, merchandise, logo/trademark use, AI training, or sensitive content) may require a separate or extended license or may be prohibited altogether. Where applicable, such information will be indicated in product descriptions, licensing documents, or on request.
If there is any conflict between these Terms and a specific license or product description, the more specific licensing terms will usually prevail for that particular item.
8. Services and Bookings
Certain services (including but not limited to Creative Greetings, Live & Loud, Meme Lab, and Full-Service Shoots) may be offered online, remotely, or in person.
Details about each service, including scope, timing, deliverables, and any additional terms, may be specified:
On the relevant service page;
In the order/booking process; or
In a separate agreement, service confirmation, or statement of work.
By booking or using any service, you agree to comply with any such additional terms.
Rescheduling, cancellations, and service-related refunds are handled according to our Refund Policy and any specific service terms communicated to you.
9. User Conduct
You agree not to use the Website or Services to:
Violate any applicable law or regulation;
Upload, post, or transmit any content that is unlawful, offensive, defamatory, obscene, or otherwise objectionable;
Infringe any intellectual property rights, privacy rights, or other rights of any person;
Distribute viruses, malware, or harmful code;
Attempt to gain unauthorised access to our systems or other users’ accounts;
Interfere with the proper functioning or security of the Website or Services.
We reserve the right, but are not obligated, to monitor and review activity on the Website and to remove or disable access to any content that, in our reasonable opinion, violates these Terms or applicable law.
10. Contributors / Sellers
Certain users may be granted the ability to upload, submit, or sell their own photographs or other content on Pictivio (“Contributors”).
If you act as a Contributor, you agree to the following, in addition to all other applicable sections of these Terms:
10.1 Your responsibilities
You represent and warrant that:
You are the owner of, or have all necessary rights and permissions to use, upload, license, and sell the content you provide;
Your content does not infringe any copyright, trademark, or other intellectual property right;
You have obtained all necessary model releases, property releases, and other permissions (where applicable) for individuals, locations, or objects depicted in the content;
Your content does not violate any laws or third-party rights, and is not misleading, defamatory, or offensive.
You remain solely responsible for your content and for any claims arising from it.
10.2 License to Pictivio
By uploading or submitting content, you grant Pictivio a worldwide, non-exclusive, transferable, sublicensable, royalty-bearing or royalty-free (as applicable under your contributor arrangement), licence to:
Host, store, reproduce, display, adapt, and distribute your content on or through the Website and Services;
Sell, license, and make your content available to customers in accordance with the pricing, licensing models, and options made available on the Website;
Use your content for the promotion of the Website and Services, including in marketing materials, previews, and portfolios, in a reasonable manner.
This licence continues for as long as your content is available on the Website and, to a reasonable extent, thereafter for archival, record-keeping, and legal purposes.
10.3 Earnings, payouts, and contributor terms
Details regarding:
Contributor compensation or commissions;
Minimum payout thresholds;
Payment schedules; and
Specific contributor conditions
may be set out in a separate Contributor Agreement, contributor dashboard information, or related documentation. In case of any conflict, such specific contributor terms will supplement or prevail over this Section for contributor matters.
We reserve the right to review, approve, reject, or remove contributor accounts or content at our reasonable discretion.
11. Intellectual Property
Except for content owned by contributors and third parties, all rights in and to the Website and Services, including but not limited to:
Text, graphics, design, layout, interface, and software;
Logos, trademarks, and trade names;
Original photographs and content created or commissioned by Pictivio,
are owned by or licensed to BLOOMIFY COMPANY LIMITED and are protected by copyright and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Website solely for legitimate purposes and in accordance with these Terms.
You must not copy, modify, reverse-engineer, or create derivative works from the Website or any part thereof, except as expressly permitted by law.
12. Privacy and Cookies
Your use of the Website and Services is also subject to our Privacy & Cookies Policy, which explains how we collect, use, and protect personal data and how we use cookies and similar technologies.
By using the Website, you acknowledge that you have read and understood our Privacy & Cookies Policy, as published on the Website and updated from time to time.
13. Third-Party Links and Services
The Website may include links to third-party websites, services, or resources that are not controlled by us.
We are not responsible for the content, privacy practices, or terms of any third-party websites or services.

Pictivio and BLOOMIFY COMPANY LIMITED, and our directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Website, content, or services.
Our total aggregate liability for any claims arising out of or relating to these Terms or the use of the Website or Services shall be limited to the greater of:
(a) the total amount you have paid to us for the relevant content or service giving rise to the claim during the twelve (12) months preceding the event, or
(b) a reasonable minimum amount specified under applicable law.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

You agree to indemnify, defend, and hold harmless Pictivio, BLOOMIFY COMPANY LIMITED, and our directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

Your violation of any law or third-party rights;
Any content you upload, submit, or provide, including as a contributor.
17. Suspension and Termination
We may, at our reasonable discretion, suspend or terminate your access to the Website or Services, including your account, if we believe that:
You have materially breached these Terms;
You are engaging in fraudulent or abusive behaviour;
Continued access would expose us or other users to risk or liability.
Where reasonable and appropriate, we will attempt to notify you in advance or shortly thereafter. Termination or suspension will not affect rights or obligations already accrued at the date of termination.
18. Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with them or with the use of the Website and Services shall, to the extent permitted by law, be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law rules.
You agree that the courts of Nairobi, Kenya shall have non-exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Website, without prejudice to any applicable mandatory rights you may have under local consumer protection laws.
